Will of Elizabeth, Countess of Berkeley

In the Name of God Amen I Elizabeth Countess Dowager of Berkeley the relict of George late Earle of Berkeley deceased doe make this my last Will and Testament. My Soule with all humility of Spirit I surrender unto God the Father my Creator in the alone Merits of God the Son my Redeemer. My Body I desire may be buried att Cranford inthe county of Middlesex in the vault there which I myselfe made as neare the Body of my deceased Lord and husband George, Ealre of Berkeley, as may be. And for the manner and order of my Buryall I leave that wholy to the discretion of my Executor herein after named.

My temporall Estate I doe dispose in manner following.

I doe will and devise that all such debts as I shall owe of Right or Consciece to any person or persons whatsoever shall be paid and satisfied within the time and space of six calendar months next after my decease.

Whereas my Mannor of Lakenham with the appurtenances in the County of Norfolke and in the County and City of Norwich and all and singular my Messuages, Farmes, Lands and Hereditaments in the said County of Norfolk and inthe said County and City of Norwich now are and be in Jointure to my daughter in law Mrs Chaplyn, late the Wife of the honourable Mr George Berkeley, my son deceased and are and stand alsoe charged with the Summe of Two thousand Five hundred pounds of good English money for the portion of my Granddaughter Mrs Elizabeth Berkeley, the only daughter and child of my said deceased son Mr George Berkeley, Now I doe by this my Will give and devise my said Manor of Lakenham with the appurtenances and all and singular my Messuages, Famres, Lands and Hereditaments whatsoever in the said County of Norfolke and County and City of Norwich and every of them with their appurtenances and the Reversion and Reversions, Remainder and Remainders of the same unto the Right Honourable Charles now Earle of Berkeley, my Son his heires and assignes forever upon Condition nevertheless and in Trust that he my said son Charles Earle of Berkeley his heires and assignes doe and shall pay and satisfye unto Sir Berkeley Lucy Baronett my Grandchild the summe of five hundred pounds due and oweing to him upon my Bond or Obligation bearing date on or about the fourteenth day of December One thousand and Seaven hundred or soe much thereof as shall be unpaid att the time of my decease And alsoe all my other debts whatsoever due upon any other Bonds or by Bill or otherwise howsoever.

I doe give and devise unto the said Charles now Earle of Berkeley and Robert Nelson Esquire my Son in Law the Summe of Five hundred pounds in good English Money to be paid them within six calendar months next after my decease In trust that they the said Charles Earle of Berkeley and Robert Nelson their Executors and Administrators doe and shall Issue and dispose the said five hundred pounds upon Land Security such as shall be approved by Councell for yearly interest or otherwise dispose the same on some good Fund to the best Advantage And doe and shall receive pay and dispose the yearly Interest profitt and income of the said five hundred pounds during the naturall life of my daughter the Lady Arabella Pulteney as the same shall grow due and payable unto such person and persons only and noe others and for such uses Intents and purposes only and noe others as She my said Daughter by any writing or writings under her hand notwithstanding her Couverture with her now husband shall from time to time direct nominate and appoint The same being by Me soe devised and appointed to be disposed as aforesaid To the end and Intent that the yearly proceeds, Interest and Advantage of the said Five hundred pounds may be for the particular and private use of her my said daughter the Lady Arabella Pulteney distinct and apart from her said husband and with which her now husband is noe wayes to intermedle or have any controwling or disposing power. Neither is the same to be subject or liable to the Debts or Forfeiture of her now husband. And upon further Trust that they the said Charles Earle of Berkeley and Robert Nelson their Executors & Administrators doe and shall from the decease of my said daughter the Lady Arabella Pulteney issue and pay the yearly proceeds interest and advantage of the said Five hundred pounds as the same shall come to their hands and be received by them unto my Granddaughters Mrs Arabella Pulteney and Mrs Elizabeth Pulteney in equall parts and proportions untill they shall respectively attaine the age of one and twenty yeares or shall be marryed for and towards their Support and Education. And as and soe soone as hey shall respectively attaine the age of One and twenty yeares or shall be married which shall first happen doe and shall call in the said five hundred pounds and pay the same unto them my said Granddaughters Mrs Arabella Pulteney and Mrs Elizabeth Pulteney To whome I doe then give and devise the same five hundred pounds equally to be divided between them share and share alike for their own respective uses and benefitts Provided That in case either of my said Granddaughters Mrs Arabella Pulteney and Mrs Elizabeth Pulteney shall dye before she shall be marryed Then the further Trust of and concerning the said Five hundred pounds thatthe said Charles Earle of Berkeley and Robert Nelson and the Survivour of them his Executors and Administratos doe and shall pay the said Five hundred pounds unto the survivour of my said Granddaughters Mrs Arabella and Mrs Elizabeth Pulteney as and when she shall attaine the age of one and twenty yeares or shall be marryed which shall first happen. My will and meaning being That in case any of my said Granddaughters shall dye under the age of one and twenty yeares and before she shall be married That in such case the Survivour of them shall have the whole five hundred pounds for her own use and Benefitt. And my further will is that in case both my said Granddaughters Mrs Arabella and Mrs Elizabeth Pulteney shall dye under the age of One and twenty yeares and before they shall be married Then upon further Trust that they the said Charles Earle of Berkeley and Robert Nelson and the Survivour of them his Executors and Administrators after the decease of my said daughter the Lady Arabella Pultenety and such the decease of both my said Granddaughters Mrs Arabella and Mrs Elizabeth Pulteney under the age of one and twnety yeares without being married as aforesaid doe and shall pay and dispose the said Five hundred pounds unto my said Granddaughter Mrs Elizabeth Berkeley att her age of one and twenty years or day of Marriage which shall first happen. And the Interest and proceeds of the said Five hundred pounds in the mean time unto her my said Granddaughter Mrs Elizabeth Berkeley for her better support and Education And in case she my said Granddaughter Mrs Elizabeth Berkeley shall likewise dye under the age of One and twenty yeares without being married Then my will is that the said five hundred pounds and every parte thereof shall goe unto and belong unto my said Son Charles Earle of Berkeley his Executors and Administrators to whome I doe then give and bequeath the same and to or for noe other Trust, Intent or purpose whatsoever.

I doe give and devise unto my said daughter the Lady Arabella Pulteney the Summe of Fifty pounds of good English money to be paid into her owne hands by my Executor hereinafter named within One months after my death. I doe give and devise unto my daughter in law the Countesse of Berkeley for her owne use and benefitt my biggest pearl buckles and drops and my glass presses and all my christalls aggetts and other things which shall be therein att the time of my decease And also all my India plate and China which usually stand upon the same presse. And I doe give and devise my Sardonyx jewell unto my said son Charles Earle of Berkeley for his Life and after his death I will and devise the use of the said Sardonyx jewell unto my Grandson the Right Honourable James Lord Berkeley for his life and after his death my will and meaning is that the said Sardonyx jewell shall remaine and be as an heireloome in my family forever. I give unto my said Granddaughter Mrs Elizabeth Berkeley my pearle and diamond pendants she usually wears in her Eares and my sixteen Fosset diamonds which I use to weare in a buckle and my gold watch and chaine and all upon it. And I desire my said daughter in law the Countess of Berkeley to keepe these things for my said Granddaughter Mrs Elizabeth Berkeley untill she shall attaine the age of sicteen yeares or be married which shall first happen And then to deliver them to her my said Granddaughter Mrs Elizabeth Berkeley. But in case my said Granddaughter Mrs Elizabeth Berkeley shall dye under the age of sixteen yeares without being married Then I give thesaid pearle and diamond pendants and sixteen Fosset diamonds gold watch and chaine and things therupon unto my said Grandson James Lord Berkeley for his owne use and benefitt.

Item I doe hereby further give and bequeath unto the said Charles Earle of Berkeley and Robert Nelson One hundred pounds Stock in the East India Company which is in the name of Mr Charles Weston (and who hath by deed declared a Trust thereof for me) upon Trust that they the said Chalres Earl of Berkeley and Robert Nelson and the Survivour of them and his Executors and Administrators doe receive and take the profitts and dividends arising and to be made pf the said One hundred pounds Stock and improve the same for the best Advantage of my said Granddaughter Elizabeth Berkeley untill the age of one and twenty yeares or day of marriage which shall first happen. And when and as soone as my said Granddaughter Elizabeth Berkeley shall have attained her said age of one and twenty years or shall be amrried Then my will is that my said Trustees shall transfer the said One hundred pounds Stock and likewise pay the said profitts and dividends and improvements thereof unto her my said Granddaughter Elizabeth Berkeley for her owne use and benefitt. But in case the said Elizabeth Berkeley shall dye under the age of one and twenty yeares without being married then my will is that the said One hundred pounds stock with the profitts dividends and improvements thereof shall goe unto and belong unto my said son Charles Earle of Berkeley To whom I doe then give and devise the same.

Item I doe give and devise unto my said son Charles Earle of Berkeley and Robert Nelson the summe of Foure hundred pounds in good English money In trust that they the said Earle and Robert Nelson and the survivour of them his executors and administrators doe putt out the same for yearly interest or otherwise for the best profitt and advantage they can gett for the same and doe receive pay and dispose the said interest and profitt of the said foure hundred pounds for and towards the Education and Maintenanceof my said Granddaughter Mrs Elizabeth Berkeley If they my said Trustees shall think it fitting and necessary or otherwise retaine the same in their hands as to them shall seeme meete. And when and soe soone as the said Elizabeth Berkeley shall attaine her said age of one and twenty yeares or shall be married which shall first happen Then they my said Trustees shall call in the said foure hundred pounds and pay the same together with such Interests and profitts thereof as shall have been by them soe retained unto her my said Granddaughter Elizabeh Berkeley To whome I doe give and devise the same for her owne use and benefitt. But in case the said Elizabeth Berkeley shall dye under the age of one and twenty yeares without being married Then they my said Trustees and the Survivour of them his Executors and Administratots doe and shall pay and dispose of the said summe of Foure hundred pounds unto my said Grandchildren Mrs Arabella Pulteney and Mrs Elizabeth Pulteney equally betweene them at their respective ages of One and twenty yeares or day or days of marriage which shall first happen. And if either of them shall happen to dye before that age or marriage Then the said Two hundred pounds to be paid to the Survivour of them my last named Grandchildren att the time before appointed. And my will is that the remaining Two hundred pounds of the before mentioned summe of Foure hundred pounds shall fall into the Residue of my Estate for the benefit of my said son Charles Earle of Berkeley.

Item I give unto my said son Charles Earle of Berkeley my Italian Clock. I doe give nd devise unto the Free schoole of Berkeley in the County of Gloucester for such uses as my said son Charles Earle of Berkeley shall direct the summe of Forty pounds of good English money. And I give and devise unto four such Non Juring Ministers as my said son in law Robert Nelson shall think fitt the severall summes of Ten pounds a piece of like money. And I doe appoint my Executor herein after named to pay the same Forty pounds into the hands of him my said son in law for that purpose. I give and devise unto the poore of Cranford aforesaid where I now dwell the summe of Ten pounds in good English money to be distributed among them by the Inister there for the time being as it shall be most needfull. Item I give and devise unto the said Charles Weston who was Steward to my late Lord and husband the summe of Ten pounds of god English money And to William Hickman my Buttler the summe of Twenty pounds of like money. I doe give and devise unto my Woman and all such other my serants as shall be in my service att the time of my death and shall have served me by the space of two yeares before and to Each of them respectively One full yeares wages over and besides what shall be severally due to them att the time of my decease.

All the rest and Residue of my Estate Reall and personall (not herein before particularly disposed of) I give and bequeath unto my said son Charles Earl of Berkeley for and towards the performance of this my Will not in any manner doubting his full and true performance of the same according to my intent and meaning. I doe make constitute and appoint my said son Charles Earle of Berkeley sole Executor of this my last Will and Testament and doe hereby revoke all other wills by me att any time heretofore made or declared. In testimony that this is my last Will and Testament contained in eight sheetes of paper I have to every of the said sheets subscribed my name and to the top of the first and bottom of the last sett my seale the six and twentieth day of August One thousand and Seaven Hundred and Six And in the Fifth yeare of the Reigne of our Sovereigne Lady Anne Queen of England &c.

Whereas in my Will date the 26th August 1706 I have devised and given to my Woman and all such other servants not particularly named in my will as shall be in my service att the time of my death and shall have served me the space of two yeares before and to each of them respectively One full yeares Wages over and besides what shall be severally due to them att the time of my decease My will and pleasure now is and I doe hereby devise and give my Woman and all such other servants not particularly named in my Will and shall be in my service at the time of my death and shall have served me the sapce of one full yeare before and to each of them respectively one full yeares wages over and besides what shall be severally due to them att the time of my decease.

An Account of some particular things which I desire may be distributed by my Executor to the persons hereafter mentioned, these things being too inconsiderable to be inserted in my last will But I leave this paper in it as a Testimony of this my Desire and to that End have signed and sealed it this Twenty Sixth of August 1706 the same day I executed my last Will and Testament.

To my daugghter the Countess of Tankerville a picture of a night-piece by Shalton and my toothpick of Gold sett with diamonds.To my daughter the Lady Clifford a little gold Bottle sett with diamonds and a Ring sett with diamonds and emeralds. To my daughter the Lady Arabella Pulteney my Ruby Ring, Two China pott with spouts and gilt heads and a wrought cutwork sheete that usually lyes upon the Calimanco Bed. To my Son in Law Robert Nelson my black and scarlet calimanco bed with the quilt and bedding that belongs to it and the chaires covered with the same stuffe and a picture of Lilly of a dwarfe and a statue on which he leans his hand. To my Granddaughter the Lady Ossulton a gold Box sett with diamonds. To my Granddaughter Mrs Elizabeth Pulteney a Ring with one diamond which I usually weare upon the little finger of my right hand. To my Granddaughter Mrs Elizabeth Berkeley the lackered Cabinett in my Dressing Roome the Indian Trunk and Indian Box I lock my thread & needles in, the Lokking Glass and table in the aforesaid Dressing Room with soe many Bookes as I have caused her to write her Name in. To my Grandson Sir Berkeley Lucy his mothers picture. To my worthy friend the Countess Dowager of Denbigh my Cordiall Cup and Salver of Indian plate. To Mrs Plot my silver gilt Tankard. The Five Diamonds I have lent to my daughter Clifford are by will disposed of to my Granddaughter Mrs Elizabth Berkeley. To the Reverend William Reeves Minister of the parish of Cranford five guineas for mourning.

I further desire my Executor to distribute the following things and as a Testimony of this my desire I have signed and sealed at the Bottom of them the Thirteenth day of November One Thousand Seaven hundred and Eight. To my daughter Tankerville the Lockett of my Lords hair sett with foure diamonds and a little Bracelett of Table diamonds which I used to weare with it. To my daughter Clifford the picture of my daughter Tankerville upon the staircase. To Mrs Knight one of my silver salvers.
